These terms cover our website, not our client work
These terms apply to your use of bydefault.studio only. They do not govern any project, engagement, or commercial relationship with us. Work we do for clients is covered by separate written agreements (proposals, statements of work, and master services agreements). Nothing on this site is an offer, quote, or contract for services.
Using the site
You may use this site for your own information and for getting in touch with us. You agree not to:
- use the site in any way that breaks the law or infringes anyone's rights;
- copy, scrape, harvest, or systematically extract content or data from the site;
- reverse-engineer, disrupt, or attempt to gain unauthorised access to the site, our Playground experiences, or any system behind them;
- introduce malicious code, or place undue load on the site;
- misrepresent your identity or affiliation, or use the site to mislead others.
We may suspend, restrict, or withdraw access to all or part of the site at any time, without notice.
Our content and intellectual property
Unless stated otherwise, everything on this site (text, design, code, graphics, video, our name, and our logo) is owned by By Default or used with permission, and is protected by intellectual property laws.
You may view and share links to our pages for personal, non-commercial use. You may not reproduce, republish, sell, or exploit any part of the site without our prior written permission.
Client names, logos, and case studies
This site features work we've produced, including the names, brands, trademarks, and campaign materials of the organisations involved. In some cases we worked directly with a brand. In others we delivered the work through a partner, publisher, or agency and were in contact with the end brand in a supporting capacity. Featuring a brand's name or logo reflects our involvement in the work shown. It does not necessarily indicate a direct contractual relationship with that brand, nor any endorsement of By Default by it. All names, logos, and trademarks belong to their respective owners, and nothing here grants you any right to use them.
The Playground
Our Playground contains interactive, experimental pieces: prototypes, concepts, and explorations made to demonstrate our thinking and our craft. Some are unconnected to any client work, and some reference brands, films, events, or organisations we have not worked with. Any third-party names, logos, or trademarks that appear belong to their owners and are used for illustrative and demonstrative purposes only. These pieces are independent works, and are not affiliated with, endorsed by, or sponsored by the brands or rights holders featured.
The Playground is provided "as is" for engagement and enjoyment. The pieces may change, break, or be removed at any time, and any quizzes, results, or outputs are for entertainment only, not advice you should rely on.
Links and third-party content
The site links to and embeds third-party content. For example, we use video hosted on Vimeo across the site, and some Playground experiences use interactive maps powered by Mapbox. These third-party tools are needed to make those interactive experiences work. We don't control third-party content and aren't responsible for it. A link or embed isn't an endorsement, and your use of third-party services is governed by their own terms.
Disclaimers
We work hard to keep the site accurate and available, but we provide it "as is" and "as available". We don't guarantee that the site will be uninterrupted, error-free, secure, or free of harmful components, and we make no warranties about the accuracy or completeness of its content. To the fullest extent permitted by law, we exclude all implied warranties.
Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under English law.
Subject to that, we are not liable for any loss of profit, loss of business, loss of data, or any indirect or consequential loss arising from your use of (or inability to use) this site, and our total liability to you in connection with the site is limited to £100.
Changes to these terms
We may update these terms from time to time. The version published here is the one that applies. The "last updated" date shows when we last made changes, and continuing to use the site means you accept the current terms.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute relating to them.
